1. Agreement to Terms

By accessing and using GoThumbnails ("Service"), operated by Quick Flip Services, Netherlands ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Service.

2. Description of Service

GoThumbnails is an AI-powered platform that provides:

• AI Thumbnail Generation: Create professional YouTube thumbnails using artificial intelligence
• Custom Prompt Thumbnails: Generate thumbnails based on your specific prompts
• HD Image Generation: High-definition image creation and enhancement
• Video Content Creation Tools: Including unlimited generation of:
  • YouTube video titles
  • Video tags and keywords
  • Video descriptions
  • Video scripts and hooks
• Video Metadata Management: Organize and manage your video content information

3. User Accounts and Eligibility

3.1 Account Creation

• You must create an account using Google OAuth authentication
• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account

3.2 Eligibility

• You must be at least 13 years of age to use our Service
• If you are under 18, you represent that you have parental consent
• You must comply with all applicable laws in your jurisdiction

4. Subscription Plans and Pricing

4.1 Available Plans

• Free Plan: 5 thumbnail credits (one-time), 50 video content generations (one-time)
• Hobby Plan: $9/month or $90/year, 50 thumbnail credits (monthly refill), unlimited video content
• Creator Plan: $29/month or $290/year, 150 thumbnail credits (monthly refill), unlimited video content
• Scale Plan: $79/month or $790/year, 500 thumbnail credits (monthly refill), unlimited video content

4.2 Credit System

• Thumbnail generation requires credits (1 credit per thumbnail)
• HD image generation requires credits (1 credit per image)
• Video content features are unlimited for paid subscribers
• Free users receive limited video content generations

4.3 Billing and Payment

• All payments are processed through Stripe
• Monthly subscriptions renew automatically
• Annual subscriptions are billed upfront with 2 months free
• All prices are in USD and include applicable taxes

4.4 Refunds and Cancellations

• You may cancel your subscription at any time through your account settings
• Cancellations take effect at the end of the current billing period
• No refunds for partial months or unused credits
• Credits do not carry over between billing periods

5. Acceptable Use Policy

5.1 Permitted Uses

You may use our Service to:

• Create original thumbnails and video content for legitimate purposes
• Generate content for your own YouTube channels or business
• Create educational or promotional materials

5.2 Prohibited Uses

You may NOT use our Service to:

• Generate content that violates YouTube's Community Guidelines
• Create misleading, deceptive, or false content
• Generate content that infringes on intellectual property rights
• Create content containing hate speech, harassment, or discrimination
• Generate sexually explicit, violent, or illegal content
• Attempt to reverse engineer or compromise our AI systems
• Share or resell generated content as your own AI service
• Abuse the "unlimited" features through automated or excessive requests

5.3 Fair Usage Policy

For unlimited features:

• Normal usage patterns are expected
• Excessive automated requests may result in temporary restrictions
• We reserve the right to implement reasonable usage limits to prevent abuse

6. Intellectual Property Rights

6.1 Your Content

• You retain ownership of any original content you input into our Service
• You grant us a license to process your content to provide our Service
• You are responsible for ensuring you have rights to any content you input

6.2 Generated Content

• You own the AI-generated thumbnails and content created through our Service
• You may use generated content for commercial purposes
• You may not redistribute or resell generated content as part of a competing AI service

6.3 Our Platform

• GoThumbnails platform, technology, and algorithms remain our property
• Our trademarks, logos, and branding are protected intellectual property
• You may not copy, modify, or create derivative works of our platform

7. Data Processing and Storage

7.1 Data Collection

We collect and process:

• Account information (email, name, profile picture)
• Subscription and payment data
• User-generated prompts and content
• Generated images and thumbnails
• Usage analytics and performance data

7.2 Data Storage

• Generated images are stored in Microsoft Azure Blob Storage
• Account and subscription data is stored in Supabase
• We implement industry-standard security measures

7.3 Data Retention

• Account data is retained while your account is active
• Generated content may be retained for service improvement
• You may request data deletion by contacting support

8. Third-Party Services

Our Service integrates with:

• Google: For authentication services
• Stripe: For payment processing
• Replicate: For AI image generation
• Microsoft Azure: For image storage
• Affonso: For analytics and referral tracking

Your use of these services is subject to their respective terms of service.

9. Service Availability and Modifications

9.1 Service Availability

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be announced when possible
• We are not liable for service disruptions beyond our control

9.2 Service Modifications

• We may modify, update, or discontinue features with notice
• We may adjust pricing with 30 days' notice for existing subscribers
• We may implement new usage limits or restrictions as needed

10. Disclaimers and Limitations of Liability

10.1 Service Disclaimer

• Our Service is provided "as is" without warranties of any kind
• We do not guarantee the accuracy or quality of AI-generated content
• We are not responsible for how you use generated content

10.2 Limitation of Liability

• Our total liability is limited to the amount you paid in the 12 months preceding the claim
• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for content that violates platform policies after generation

10.3 User Responsibility

• You are solely responsible for your use of generated content
• You must ensure compliance with applicable platform policies
• You indemnify us against claims arising from your use of our Service

11. Termination

11.1 Termination by You

• You may terminate your account at any time
• Cancellation takes effect at the end of the current billing period
• You remain responsible for all charges incurred before termination

11.2 Termination by Us

We may terminate or suspend your account for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of our Service or systems
• Non-payment of fees

11.3 Effect of Termination

• Access to paid features terminates immediately
• Generated content may remain accessible for a limited time
• Outstanding payments remain due

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of the Netherlands.

12.2 Dispute Resolution

• Initial disputes should be directed to support@gothumbnails.com
• Formal disputes will be resolved through Dutch courts
• EU users may access the European Commission's Online Dispute Resolution platform

13. General Provisions

13.1 Entire Agreement

These Terms constitute the complete agreement between you and GoThumbnails.

13.2 Severability

If any provision is deemed invalid, the remaining provisions remain in effect.

13.3 Assignment

We may assign these Terms; you may not assign your rights without our consent.

13.4 Updates to Terms

• We may update these Terms with notice
• Continued use constitutes acceptance of updated Terms
• Material changes will be communicated via email or platform notification
